If the foot is pretty straight facing the front of the car, no problem. If the foot is at an angle of around 1-2 o' clock, and it moves a bit to the right after depressing the gas, as you let up on the gas the foot gets pinched between the peddle and the plastic trim. It's not hard to release it, but it is a surprising, and possibly dangerous.
You are right about the angle, and this is how I avoid the problem...but if you have a longish foot or wide boot, it doesn't take much angle...get a little sloppy and your foot will get caught.

Fixing the problem is easy anyway. See pic: removing plastic along the yellow line should be enough, but you could easily remove up to the red line without issue. There is nothing behind those areas that concerns me. use a Dremel, soldering iron with blade, small keyhole saw etc.

I will remove at the yellow line to start. Hopefully any plastic debris created will hide all that nasty crap on my floor.

EDIT:Ok, I cut off a chunk and that solves the problem. Removing the whole cover would facilitate a professional looking job, but you would also have to remove the centre console cover, and it's to darn cold to fiddle around much... so I just popped the rivet, which allows the cover to be pulled away giving you room to make a quick hack and slash. 5 minutes.

I'll clean up that mess on the floor in the spring. Maybe

Yes I am a woman, with small feet too, but the boots are still huge I hate getting my feet cold so I wear -102F boots, even when driving.

It must be the angle of my foot on the pedal but I never get cought there. I don't put my feet so high in there either.

If it's important to you, I'd report it directly to Nissan.

    Also: welcome to the forum!

Is there a Head Office contact or should I just email my dealer?

I was hoping that being proactive would help negate any accidents.

I'll probably end up doing this but it being a brand new car, I was wanting to avoid this type of solution. Thank you for your input though. Maybe Nissan will be proactive and fix this in the future?

AH! Too late, no covering your tracks now! Your secret is out, time to change your screen name to BigFoot

I doubt Nissan would address this issue any time soon, and if they did it would likely be the same solution at the dealer level (trimming). I would not be put off... mine looks a little rough because I just used 50grit paper to smooth out the cut and get the job done quickly. You can't really notice it down there from any normal angle anyway, and you can see from my pics that my foot was already making a mess of the plastic as it was.

It would be really easy trim it to look stock if you spent the extra time to remove the shroud from the car.

I implore anyone, especially those who have experienced this problem to weigh this easy mod against the possibility, however remote, of mangling a pedestrian or accidentally pulling out in front of a truck... a split second fumble with your right foot could be life changing.

Imagine how you might feel afterwards, knowing that a few minutes cutting a cheap bit of plastic...

Thanks to the OP for posting and jogging my memory on this.

    John.

I don't pretend to have any special relationship with Nissan, but I have forwarded this thread to my contact. I'll let you know what the reply is.

Good sleuthing. Seems like the same issue.

That piece looks identical to aftica's "before" picture in post#10.
