    i already took my plates and stuff from car, didnt think about taking off the hood deflector. I had no side rain deflectors on mine sadly.

    ya its because when i bought this car i still owed 8,000 dollars from my previous loan with a 2010 hyundai accent (RBC had that loan nissan paid it off and added it my new car loan) . I had negative equity in that car i owed way more then it was worth and thats how i am getting screwed over.

    if you dont mind my asking.....how much did you pay for this car's premiums? and was it full coverage? what about deductibles?

    i think im paying too much....im in bc

    I had full coverage I was only paying $169 a month. I only recently switched companies before that I was paying 323 but had an at fault accident on my record

    Is there structural damage?

    If not, would you consider buying the car from your insurance company and repairing it yourself?

    All those quotes are for new parts + full shop rates.

    You could probably do it for half that with used parts.

    So you take the payout, buy the car back from the insurer for a few grand and repair it.

    While the insurance and our laws regulate their involvement, you are still more than allowed to privately sue the driver for destruction of property - no different than the 'you break it you bought it' policies in stores, same laws apply to all possessions. it'd be unlikely that a judge would grant you more money than the value of the outstanding loan and lost time etc. but you can certainly make a case that they were 100% at fault, and broke your property to a point of disrepair as determined by the insurance company. They are either on the hook for buying out your financing, or paying to replace the car themselves.
